Supreme Court ruling on Roundup highlights law-science divide

The Supreme Court’s recent decision in Monsanto v. Durnell has reignited debates about how legal and scientific standards intersect — or clash — when it comes to causation. The ruling, which sided with Monsanto in a Roundup lawsuit, did not address whether glyphosate causes cancer. Instead, it focused on a legal technicality: federal pesticide law preempts state claims when the Environmental Protection Agency has not mandated a cancer warning on the product label. This distinction between law and science has long been a source of confusion, particularly in cases involving complex health risks.

Legal causation and scientific causation are not the same, even though both rely on the term “causation.” In epidemiology, establishing a link between an exposure and a disease requires statistical evidence, dose-response relationships, and replication across studies. Conclusions remain probabilistic, not absolute. A risk factor may increase disease likelihood without explaining why a specific individual fell ill. The legal system, however, operates on a different standard. In civil cases, plaintiffs must prove that their injury would likely not have occurred without the defendant’s conduct. This is not about proving scientific consensus but resolving disputes over individual harm.

Courts and legal professionals should clarify which causal question they are answering: general causation, specific causation, or product design. Expert testimony and media coverage must keep these categories separate. A hazard classification is not the same as proof that a product caused an individual’s injury. A settlement is not an admission of causation. Regulatory decisions differ from jury verdicts, and a Supreme Court ruling on preemption is not a scientific exoneration.

Public trust hinges on distinguishing these roles. If legal outcomes are treated as scientific findings, later scientific caution may be seen as evasive. If regulatory caution is misinterpreted as ignoring harm, courts may appear irrational. Science aims to estimate risk and identify patterns. Law aims to assign responsibility and compensate injury. These functions are related but not the same. Clear communication from courts, experts, and journalists is essential to prevent misunderstandings and preserve trust in both systems.
